Megaron the Athens Concert Hall Organisation (hereinafter “OMMA”) created the website megaron.gr in order to provide users with information and services relating to its activities. OMMA is the owner of the website megaron.gr and makes its content available in accordance with the following terms of use (hereinafter the “Terms of Use”), which users are asked to read carefully and to use the pages and/or services of the site only if they fully accept them. Use of the megaron.gr website constitutes automatic acceptance of these Terms of Use, as amended from time to time by OMMA and in force at the relevant time.

Website content

The name, distinguishing title, logo, images, graphics, distinctive features, as well as the entirety of the content, information, electronic files, services and all other material contained on the megaron.gr website, belong exclusively to OMMA and constitute protected intellectual property. The names or other intellectual and industrial property rights of third parties displayed on the website are likewise protected under applicable law.

Users are expressly prohibited from exploiting, copying, reproducing, distributing, republishing, making available or transmitting, or otherwise using in any manner, the content and services of this website, beyond the uses expressly permitted on this website, without OMMA’s prior written consent. An exception applies to journalists working in cooperation with OMMA (under written instruction from OMMA), who are permitted to use press releases as issued, or to amend them in accordance with their professional code of ethics, for the purpose of promoting and publicising OMMA’s events. In all cases, press releases remain the intellectual property of OMMA and are protected under the relevant provisions of Greek law and international conventions. OMMA reserves the right, at any time, to deny a journalist access to the relevant page. Journalists’ personal data are held on OMMA’s records and are never disclosed to third parties.

The website’s content includes valid, up-to-date and lawful information. OMMA makes every effort to ensure that the information and content of the website are accurate and clear. In all cases, OMMA bears no liability towards the user for any damage that may result from information provided not being kept up to date.

The website may refer, via “links” (hyperlinks) etc., to other websites, the providers of which bear full responsibility for the security, legality and validity of the content of their own websites. Users should familiarise themselves with the terms of use of those specific websites and, provided they agree with them, accept them. In all cases, OMMA bears no liability towards users for their use of third-party websites, merely on account of those websites being linked to from this website.

OMMA bears no liability for any damage that may be suffered by a visitor to the website or by a third party, arising from a cause related to the operation or non-operation and/or use of the website, and/or from any inability to provide services and/or information made available through it.

User obligations

Users of this website must comply with the applicable rules and provisions of Greek, European and International Law, and must make lawful and appropriate use of the website in accordance with these Terms of Use. Visitors must refrain from any unlawful use of the website’s content and services, or any use contrary to trade custom, unfair or abusive. In particular, but without limitation, any act that is contrary to the law, or that may cause harm to OMMA and/or third parties, is expressly prohibited.

Any damage caused to this website and to OMMA, or to the network in general, arising from unlawful, improper use of the website and its pages and/or services in breach of these Terms of Use, shall be borne exclusively by the user, and OMMA reserves the right to exercise any legal remedy available to it in defence and safeguarding of its interests; the offending party shall be liable to compensate OMMA for any resulting damage.

Availability of content

OMMA makes every effort to maintain and provide access to the website. However, it cannot guarantee that the website, or any information and/or service included on it, will be provided without interruption and/or error. Furthermore, OMMA reserves the right to modify and/or temporarily or permanently discontinue all or part of the website, with or without notice to users, since its availability also depends on factors beyond OMMA’s control. In all cases, OMMA bears no liability if a user is unable to connect to the website.

OMMA makes every possible effort to protect the website from malicious software. Nevertheless, it does not guarantee that the website, or the servers through which its content and services are provided to users, are free of viruses or other harmful components. Each user should take their own measures to protect their own means of access before making any use of the website.

Personal data

The Data Controller is the legal entity governed by private law named “Megaron the Athens Concert Hall Organisation,” with its registered office in Athens (1 Vas. Sofias & Kokkali Street, 11521).

OMMA may keep records of, and process, any personal data of website users that comes to its knowledge through requests and/or transactions, for the purpose of supporting, promoting and carrying out the purpose for which the website is used. This data includes, in particular, the user’s full name, contact details, and the content of the user’s requests or reports.

Depending on the purpose of the processing, the legal basis may be the user’s consent, the performance of a contract or pre-contractual measures (e.g. the purchase of tickets), compliance with a legal obligation, or OMMA’s legitimate interest, always in accordance with Regulation (EU) 2016/679 (GDPR) and Law 4624/2019. Recipients of this data may include, as applicable, third-party natural or legal persons acting as processors on behalf of OMMA, such as, indicatively, a newsletter delivery service provider, the ticketing platform providers LOGISMIKI E.P.E. and the site developer V. GKOTSIS & Co.. Every visitor retains the right to be informed of, and to object to, further processing of their data.

OMMA bears no liability towards the user in the event of use of personal data that the user has provided to a third-party natural or legal person via a hyperlink to that third party’s website, accessed through OMMA’s website.

Processing is carried out both by computer and in paper form, and the security measures required under applicable law are always applied. Data is processed in particular for the handling of requests for information submitted by users through the website, and for the handling of reports concerning any undesirable conduct.

Personal data is accessible only to OMMA staff who are authorised to process it in the course of their duties (e.g. technical and administrative staff), as well as any supervisory persons, in accordance with the principles of data access minimisation, lawfulness and transparency. Data is retained only for as long as is strictly necessary to achieve the purpose for which it was collected, taking into account any statutory retention periods where applicable, for a maximum of 10 years for tax documents relating to ticket purchases, in accordance with tax legislation.

Where processing involves the transfer of data outside the European Union/EEA (e.g. via website traffic analysis tools or social media platforms), such transfer takes place only where an adequate level of protection is ensured, through appropriate safeguards such as the European Commission’s Standard Contractual Clauses.

The user may exercise at any time the rights granted under the GDPR, namely: the right to be informed of, and to access, their data; the right to rectification; the right to erasure (“the right to be forgotten”); the right to restriction of processing; the right to data portability; the right to object to processing (including direct marketing); and the right to withdraw consent at any time, without affecting the lawfulness of processing carried out prior to withdrawal. The user may also lodge a complaint with the Hellenic Data Protection Authority (www.dpa.gr). To exercise the above rights, the user may contact OMMA at webmaster@megaron.gr.

Specifically with regard to the creation of a personal (web) account, which requires details such as full name, email and telephone number, the user must be at least 18 years of age and have full legal capacity. In cases where tickets are purchased on behalf of, or for the benefit of, a minor, the relevant purchase and data processing is always carried out through the account of an adult parent or guardian, who bears the corresponding responsibility.

User accounts (web account)

The website enables users to create their own account, in order to receive newsletters and personalised information, to be kept informed of OMMA’s services, events and concerts, and to purchase tickets. To create a personal account, the user must register by completing the online registration form. The user is solely responsible for the details they provide, which must be true and accurate. If OMMA establishes that untrue details have been provided, it may cancel that user’s registration, even at a later date.

Among the details the user must provide when creating their account are their full name, email address and telephone number. The email address must be genuine, complete, personal to the user, and under the user’s full control. OMMA may process the email address to ensure it is correctly recorded.

When creating the account, the user sets a password of their choosing. Access to the personal account is enabled through the use of the email address and password. These details are personal to each user and must not be disclosed to third parties. The user is solely responsible for all actions carried out using their email address and password, and must notify OMMA of any unauthorised use. In all cases, OMMA is not liable to the user for any damage that may result from such use.

OMMA is committed to safeguarding personal data in accordance with these Terms of Use and applicable law. A registered user may request the deletion of their account and the destruction of their personal data by submitting a request to OMMA at webmaster@megaron.gr. If a user has active tickets when they request deletion of their account, their data will be retained for six months from the date of the last event for which they hold active tickets, and will then be deleted automatically.

Use of cookies

To personalise the user’s visit to the website and to ensure the operation of certain of its features, OMMA uses “cookies” to collect and store data. Cookies are small text files sent by the website and stored on the user’s computer or mobile device; they may include information such as browser type, device type, operating system and internet service provider. Cookies do not cause any harm to the user’s device, nor do they reveal the user’s identity, although they may be used to identify the user’s device.

The website uses cookies for: (a) statistical analysis of traffic and improvement of content/services (e.g. Google Analytics), and (b) social media functions, enabling visitors to share content. On first visiting the website, a message (cookie banner) is displayed, through which the user may accept or reject the use of cookies. If the receipt of cookies is disabled, certain functions of the website may not be available, or certain pages may not display correctly.

General terms

These Terms of Use may be amended without prior notice; users should therefore visit this page regularly in order to stay informed of any amendments.

Where the use of any service on the website is governed by more specific terms, those terms are considered to form a single whole together with these Terms of Use; in the event of conflict, the more specific terms shall prevail.

The invalidity of any of these Terms of Use shall not entail the invalidity of the remaining terms. OMMA’s failure to exercise any right arising from these Terms of Use shall not constitute a waiver of that right. OMMA shall not be liable for any breach of these Terms due to force majeure.

Any dispute arising between OMMA and the user, from or in connection with these Terms of Use, shall first be resolved in accordance with trade custom and good faith. Should this prove impossible, Greek law shall apply and the Courts of Athens shall have jurisdiction.
